In the document, there was a quick written reference of a shortfall of $497,000 for Health Care Benefits, "mostly on the employer side"… During the verbal presentation by the CBO, there was an abbreviated PowerPoint. There was no mention of the amount, the violation of the CBA contract, the "overage of benefits", or any explanation of the history, etc.

Apparently, when the prior superintendent was terminated not all of his access rights and authorities were disabled. Per staff, he had active credentials, access to certain accounts, and email for several months.

I move that the board of education approve the 2025 2026 collective bargaining agreements as presented and further direct the superintendent and staff to: Number one engage with employee union leadership to address the district's current overspending on health care contributions for the 2025-26 school year including discussion of a potential agreement to amend the existing contracts to reflect a mutually acceptable resolution.

The forensic accounting firm stated that LBUSD did not set employee contributions according to the language contained in the CBA, and consequently the district covered more of the total annual cost than it should have. They went on to say that whether this lack of compliance is evidence of a material breach or impropriety requires a legal review and conclusion (outside the scope of what they were asked to do).

At the December 16 LBUSD Special Meeting, the board unanimously approved necessary budget adjustments to address an approximately $850,000 shortfall for current fiscal year… The board agreed to cover the shortfall without seeking repayment from staff. No action was on the agenda nor directed by the board regarding investigation into underlying cause of the multi year contract breach.

Oversight of the superintendent is not an attack on teachers. The superintendent reports to the board. Oversight is a legal responsibility, not "interference." At the February 26 Governance meeting, this was explained by district legal counsel.

The mid-April "march" was a union leadership promoted and sponsored "protest" designed to pressure the board in currently active contract negotiations. Contract negotiations were happening simultaneously to the protest march.
